SWAGGER OFFICE & STUDIO VISITOR WAIVER, RELEASE OF LIABILITY & MEDIA RELEASE

Welcome to Swagger.

Thanks for visiting our office and production studio. We’re excited to have you here. Our studio is a real working creative environment. At any given moment, our team may be building sets, moving equipment, flying drones, operating cameras, adjusting lighting, recording audio, constructing props, or filming content. It’s an active space where things move quickly and conditions can change throughout the day.

While we are committed to maintaining a safe workplace, we ask every visitor to remain aware of their surroundings and follow the guidance of our team while on-site. By entering the Swagger premises, you acknowledge and agree to the following:

1. Assumption of Risk

I understand that visiting the Swagger offices, studio, warehouse, production spaces, parking areas, loading areas, and surrounding property involves certain inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to:

• Camera, lighting, grip, audio, and production equipment
• Electrical cables, power distribution, extension cords, and generators
• Ladders, scaffolding, lifts, platforms, and elevated work
• Temporary walls, sets, props, furniture, décor, and construction materials
• Hand tools, power tools, fabrication equipment, and shop activities
• Moving production carts, equipment, vehicles, forklifts, or other machinery
• Drones or other remote-operated equipment
• Wet floors, uneven surfaces, loading docks, stairs, and trip hazards
• Active filming, photography, rehearsals, interviews, and production activities
• Loud noises, flashing lights, special effects, haze, smoke, or other production elements
• Other conditions commonly associated with commercial production studios and creative workspaces

 
I understand that production environments are dynamic and that hazards may change throughout my visit.
 
I voluntarily assume all risks associated with entering and remaining on the premises.

2. Visitor Responsibilities

While on the premises, I agree to:

• Follow all instructions provided by Swagger employees and production staff.
• Stay within designated visitor areas unless escorted by a Swagger team member.
• Not enter active production, warehouse, or equipment areas without permission.
• Not touch cameras, lighting, props, equipment, sets, tools, or other production materials unless invited to do so.
• Wear appropriate clothing and closed-toe shoes whenever practical.
• Exercise reasonable care for my own safety and the safety of others.
• Immediately report any unsafe condition, accident, or injury to a Swagger employee.
• Supervise any children or guests accompanying me at all times.

3. Release of Liability

To the fullest extent permitted by applicable law, I release, waive, and forever discharge Swagger, its owners, officers, employees, contractors, affiliates, clients, vendors, successors, and representatives from any and all claims, demands, causes of action, liabilities, damages, costs, expenses, or losses arising out of or relating to my presence on the premises or participation in any activities occurring thereon, including claims for personal injury, illness, death, property damage, or economic loss, except to the extent caused by the gross negligence or willful misconduct of Swagger.

4. Personal Property

I understand that I am solely responsible for my personal belongings.
Swagger is not responsible for lost, stolen, or damaged personal property while I am on the premises.

5. Photography, Video & Media Release

I understand that Swagger is an active content creation company and that photography, video recording, audio recording, livestreaming, and other forms of media capture may occur at any time throughout the facility.

By entering the premises, I grant Swagger, its affiliates, successors, licensees, and assigns the unrestricted, perpetual, irrevocable, worldwide, royalty-free right to photograph, film, record, livestream, and otherwise capture my name, likeness, image, voice, appearance, statements, and participation.

I authorize Swagger to edit, reproduce, publish, distribute, display, broadcast, modify, and otherwise use such recordings, in whole or in part, in any format or media now known or later developed, including but not limited to:

• Marketing and advertising
• Social media
• Website content
• Portfolio work
• Case studies
• Sales presentations
• Promotional materials
• Show reels
• Behind-the-scenes content
• Recruiting materials
• Internal communications
• Educational or training materials
• Future creative projects
• Any other lawful business purpose

 
I understand that I will receive no compensation, royalties, ownership rights, or other consideration for the use of my image, likeness, voice, or appearance.
 
I waive any right to inspect or approve the finished content or its future use.

I further release Swagger from any claims relating to privacy, right of publicity, defamation, emotional distress, or copyright arising from the lawful use of such materials.

6. Emergency Medical Authorization

In the event of an emergency, I authorize Swagger personnel to seek emergency medical assistance on my behalf if I am unable to do so.
I understand that I am solely responsible for any medical expenses incurred.

7. Compliance with Safety Instructions

I agree to comply with all posted safety signs and all instructions from Swagger personnel.
Swagger reserves the right to remove any visitor who fails to follow safety instructions or whose actions may create an unsafe environment.

8. General Agreement

I certify that:

• I am at least 18 years of age, or this waiver has been signed by my parent or legal guardian.
• I have carefully read this entire document.
• I fully understand its contents.
• I understand that I am giving up certain legal rights by signing it.
• I sign this agreement voluntarily and without coercion.
• This agreement shall be governed by the laws of the State of Illinois.
